This AI Use Policy ("Policy") governs the use of artificial intelligence, machine learning, and automated decision-support capabilities (collectively, "AI Systems") provided by Noir Stack LLC ("Company," "Noir Stack," "we," or "us") as part of its platforms, APIs, and services (the "Services").
This Policy is incorporated into and forms part of the Terms and Conditions and Acceptable Use Policy.
1. Scope
This Policy applies to all Users who access or interact with AI-enabled features within the Services, including:
- Model inference and generation systems
- Agent orchestration and automation pipelines
- Data analysis and transformation workflows
- AI-assisted decision-support tools
2. Nature of AI Systems
The Company provides AI Systems that generate outputs based on probabilistic models and computational processes.
Users acknowledge and agree that:
- AI outputs are not deterministic
- Outputs may be incomplete, inaccurate, or contextually incorrect
- AI Systems do not possess human judgment or intent
- AI outputs are generated based on input data and system configuration
3. User Responsibility
The User is solely responsible for:
- Reviewing and validating AI-generated outputs
- Determining the appropriateness of outputs for intended use
- Ensuring compliance with applicable laws and regulations
- Implementing human oversight where required
The Company does not assume responsibility for decisions made using AI outputs.
4. Prohibited AI Use Cases
Users shall not use AI Systems for:
A. Regulated or High-Risk Decisions Without Oversight
- Legal advice or legal determinations
- Medical diagnosis or treatment decisions
- Financial or investment decisions
- Employment or eligibility determinations
unless appropriate human review and qualified oversight are applied.
B. Harmful or Unlawful Activities
- Generating content that violates applicable law
- Harassment, exploitation, or abuse
- Disinformation or deceptive practices
- Circumvention of legal or regulatory safeguards
C. Security Exploitation
- Attempting to manipulate, jailbreak, or degrade AI Systems
- Extracting model internals or proprietary logic
- Circumventing safeguards or usage controls
D. Privacy Violations
- Processing personal data without lawful basis
- Attempting to infer or reconstruct sensitive information
- Unauthorized profiling or surveillance
5. Data Use and Model Training
Unless explicitly agreed in writing:
- Customer data and AI inputs are not used to train third-party public models
- Data is processed solely to deliver requested functionality and maintain system performance
- Aggregated or de-identified data may be used to improve internal systems
6. AI Output Limitations
AI-generated outputs:
- May contain factual inaccuracies or outdated information
- May reflect biases present in underlying data
- Should not be treated as authoritative or definitive
Users must independently verify outputs before reliance.
7. Transparency and Attribution
Users are responsible for:
- Disclosing AI involvement where required by law or policy
- Ensuring outputs are not misrepresented as human-generated when such distinction is material
- Maintaining appropriate attribution where applicable
8. Human-in-the-Loop Expectations
For decision-critical environments, Users are expected to implement:
- Human review and approval processes
- Validation checkpoints
- Context-aware evaluation of outputs
AI Systems are intended to assist, not replace, human decision-making.
9. Enterprise and Regulated Use
Enterprise Customers are responsible for ensuring:
- AI usage complies with internal governance frameworks
- Appropriate controls are implemented for regulated environments
- Use aligns with contractual and legal obligations
The Company does not certify AI outputs for regulatory compliance unless explicitly agreed.
10. Monitoring and Enforcement
The Company may:
- Monitor usage of AI Systems for compliance
- Restrict or suspend access for violations
- Modify or disable features to prevent misuse
Enforcement actions are taken at the Company's discretion.
11. No Warranty for AI Systems
To the maximum extent permitted under Virginia law:
- AI Systems are provided "as is"
- No guarantee of accuracy, completeness, or reliability is provided
- The Company disclaims liability arising from reliance on AI outputs
12. Relationship to Other Policies
This Policy supplements:
- Terms and Conditions
- Acceptable Use Policy
- Privacy Policy
- Data Processing Addendum
In the event of conflict, the Terms and Conditions govern.
13. Changes to This Policy
The Company may update this Policy at any time.
Material changes will be reflected by updating the "Last Updated" date. Continued use constitutes acceptance.
